394 Characteristics and reasons for litigations involving dermatitis: An exploratory analysis

Previous research has examined the causes and characteristics for litigation among patients who listed psoriasis cutaneous malignancies as reasons lawsuits. However, with any form of dermatitis have not been assessed. Therefore, goal was to assess this by an exploratory analysis using Westlaw, one largest online legal databases. Search terms “dermatitis or eczema” were used. Cases judges settlements manually reviewed excluded if unrelated overall lawsuit. Demographics, prosecution reason, verdict, type, case payouts examined. 98 out 155 cases met inclusion criteria, ranging from years 1983-2021. 59% plaintiffs female most in West (30%). Juries returning plaintiff defendant verdicts 37% 43% respectively others being settlements. Dermatitis primary cause 72% prevalent involved contact (62%) minimal atopic (5%). The median mean payout $25,000 $224,781 (range $325-$5075000). Top included toxic exposure (41%), medical malpractice (32%), negligent business practices (16%). Subgroup revealed 42% adverse reaction a product, 30% occupational hazard, 27% improper cosmetic services. Among cases: 81% won defendants, 7% defendants dermatologists, only 4% mentioned effects topical steroids. findings here demonstrate majority plaintiff-won came lawsuits where suffered sued businesses. Additionally, dermatitis, steroids side effects, against physicians. Further is warranted.
